of birth certificates"},"content":{"rendered":"<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">ATTENTION: NEW CITIZENSHIP REGULATIONS <\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Legislative Decree No. 36 of March 28, 2025, converted into law with amendments, has introduced new restrictions on the acquisition of Italian citizenship pursuant to Article 1 of Law 91\/1992.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Please read Articles 1-4 of Law 91\/1992 carefully, with specific reference to Article 3-bis.<\/span><\/span><\/p>\n<p><a href=\"https:\/\/ambtelaviv.esteri.it\/wp-content\/uploads\/2026\/01\/CITT-ENG.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-6659 796px) 100vw, 796px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Starting March 28, 2025, the transcription of birth certificates by jure sanguinis (by birth) for a minor born abroad may occur in the following cases: <\/span><\/span><\/p>\n<ol>\n<li><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The minor is exclusively Italian since he\/she is the child of exclusively Italian parents and does not acquire the citizenship of the country in which he\/she was born (e.g., a child of exclusively Italian citizens born in Israel);<\/span><\/span><\/li>\n<li><span class=\"jCAhz\"><span class=\"ryNqvb\">The minor is exclusively Italian since he\/she is the child of an exclusively Italian parent and a foreign national who does not transmit their citizenship under their national law.<\/span><\/span><\/li>\n<li><span class=\"jCAhz\"><span class=\"ryNqvb\">The minor is the child of an exclusively Italian parent or grandchild of an exclusively Italian grandparent, or whose grandparent was holding only Italian citizenship at the time of his\/her death, if such death occurred before the child&#8217;s birth (the date of the child&#8217;s birth is considered);<\/span><\/span><\/li>\n<li><span class=\"jCAhz\"><span class=\"ryNqvb\">The minor is the child of an Italian parent who lived in Italy for at least two consecutive years after acquiring Italian citizenship and before the child&#8217;s birth.<\/span><\/span><\/li>\n<\/ol>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The documentation required for the above-mentioned cases is listed under &#8220;STEP 1 \u2013 Document Preparation.&#8221;<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">In this regard, please note that <strong>the applicant must incontrovertibly demonstrate that one of the ascendants was exclusively Italian at the time of the minor&#8217;s birth, as well as prove residency in Italy<\/strong>.<\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If <strong>the minor does not fall into any of the above-listed categories, the parent who is an Italian citizen by birth<\/strong> may request the transcription of the minor child&#8217;s birth certificate through a specific declaration, which will allow the acquisition of citizenship by law pursuant to Article 4, paragraph 1-bis.<\/span><\/span><\/p>\n<blockquote><p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Who is an Italian-born parent?<\/span><\/span><\/p>\n<p><span class=\"jCAhz\"><span class=\"ryNqvb\">According to Article 3-bis of Law 91\/1992, an Italian citizen by birth is one who: <\/span><\/span><\/p>\n<p><span class=\"jCAhz\"><span class=\"ryNqvb\">Notwithstanding Articles 1, 2, 3, 14, and 20 of this Law, Article 5 of Law No. 21 of April 1983,<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">123, Articles 1, 2, 7, 10, 12, and 19 of Law No. 555 of June 13, 1912, as well as Articles 4, 5, 7, 8, and 9 of the Civil Code approved by Royal Decree No. 2358 of June 25, 1865, anyone born abroad, even before the effective date of this Article, and who holds another citizenship, is considered to have never acquired Italian citizenship, unless one of the following conditions is met: <\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">a) the applicant&#8217;s citizenship status is recognized, in accordance with the legislation applicable as of March 27, 2025, following an application, accompanied by the necessary documentation, submitted to the competent consular office or mayor no later than 11:59 PM Rome time on the same date;<\/span><\/span><\/p>\n<p><span class=\"jCAhz\"><span class=\"ryNqvb\">a-bis) The interested party&#8217;s citizenship status is recognized, in accordance with the legislation applicable as of March 27, 2025, following an application, accompanied by the necessary documentation, submitted to the competent consular office or mayor on the day indicated by an appointment communicated to the interested party by the competent office by 11:59 PM Rome time on the same date of March 27, 2025;<\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">b) The interested party&#8217;s citizenship status is judicially certified, in accordance with the legislation applicable as of March 27, 2025, following a judicial application submitted no later than 11:59 PM Rome time on the same date;<\/span><\/span><\/p>\n<p><span class=\"jCAhz\"><span class=\"ryNqvb\">c) A first- or second-degree ascendant possesses, or possessed at the time of death, exclusively Italian citizenship;<\/span><\/span><\/p>\n<p><span class=\"jCAhz\"><span class=\"ryNqvb\">d) A parent or adoptive parent has been resident in Italy for at least two consecutive years after acquiring Italian citizenship and before the child&#8217;s birth or adoption.<\/span><\/span><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>If you are an <span style=\"text-decoration: underline;\"><strong>Italian citizen by birth<\/strong> <\/span>and wish to register your minor child in the cases referred to in letters a) \u2013 d), please follow these instructions:<\/p>\n<p><strong>STEP 1 \u2013 Document Preparation<\/strong><\/p>\n<p>Gather the following documents:<\/p>\n<p>CASE 1 \u2013 The minor is an exclusively Italian citizen as the child of exclusively Italian parents and does not acquire citizenship of the country in which he or she was born.<\/p>\n<ul>\n<li><a href=\"https:\/\/ambtelaviv.esteri.it\/wp-content\/uploads\/2025\/07\/2025-Trascrizione-atto-di-nascita_fin.pdf\">Application<\/a> form duly completed and signed by both parents;<\/li>\n<li>Original Israeli birth certificate &#8220;Affirmation of Birth in Israel \u2013 Replication of Notice of Live Birth&#8221; (photocopies are not accepted) complete with &#8220;Apostille&#8221; (for more information on obtaining an Apostille, click <a href=\"https:\/\/www.mfa.gov.il\/mfa\/consularservices\/pages\/publicdocumentseng.aspx\">here<\/a>);<\/li>\n<li>Italian translation of the birth certificate;<\/li>\n<li>Photocopy of both parents&#8217; passports or identity cards;<\/li>\n<li>Proof of legal presence in Israel (visa);<\/li>\n<li>If not on file with the Consulate, documentation proving exclusive possession of Italian citizenship (certification of non-Israeli citizenship).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>CASE 2 \u2013 The minor is an exclusively Italian citizen as the child of an exclusively Italian parent and a foreign parent who does not transmit their citizenship according to their national law.<\/p>\n<ul>\n<li><a href=\"https:\/\/ambtelaviv.esteri.it\/wp-content\/uploads\/2025\/07\/2025-Trascrizione-atto-di-nascita_fin.pdf\">Application<\/a> form duly completed and signed by both parents;<\/li>\n<li>Original Israeli birth certificate &#8220;Affirmation of Birth in Israel \u2013 Replication of Notice of Live Birth&#8221; (photocopies are not accepted) complete with &#8220;Apostille&#8221; (for more certificate;<\/li>\n<li>Photocopy of both parents&#8217; passports or identity cards;<\/li>\n<li>Proof of legal presence in Israel (visa);<\/li>\n<li>If not on file with the Consulate, documentation proving exclusive possession of Italian citizenship (certification of non-Israeli citizenship);<\/li>\n<li>If not on file with the Consulate, certification issued by the authorities of the foreign parent&#8217;s country of origin stating that their citizenship status was not transmitted to the child.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>CASE 3 \u2013 <span class=\"jCAhz\"><span class=\"ryNqvb\">The minor is the child of an exclusively Italian parent or grandchild of an exclusively Italian grandparent, or whose grandparent was holding only Italian citizenship at the time of his\/her death, if such death occurred before the child&#8217;s birth<\/span><\/span>.<\/p>\n<ul>\n<li><a href=\"https:\/\/ambtelaviv.esteri.it\/wp-content\/uploads\/2025\/07\/2025-Trascrizione-atto-di-nascita_fin.pdf\">Application<\/a> form duly completed and signed by both parents;<\/li>\n<li>Original Israeli birth certificate (photocopies are not accepted) complete with &#8220;Apostille&#8221; (for more information on obtaining an Apostille, click <a href=\"https:\/\/www.mfa.gov.il\/mfa\/consularservices\/pages\/publicdocumentseng.aspx\">here<\/a>);<\/li>\n<li>Italian translation of the birth certificate;<\/li>\n<li>Photocopy of both parents&#8217; passports or identity cards;<\/li>\n<li>Proof of legal presence in Israel (visa\/Teudat Zeut);<\/li>\n<li>Certificate of residence and citizenship &#8220;Certificato contestuale di cittadinanda e residenza&#8221; issued by the Italian Municipality;<\/li>\n<li>If not available from the Consulate, certification of non-Israeli citizenship\/Israeli citizenship for the Italian parent;<\/li>\n<li>If not on file with the Consulate, a certificate issued by the authorities of the foreign parent&#8217;s country of origin stating that their citizenship status has not been transmitted and\/or documentation issued by third-party countries in the case of periods of residence in other countries;<\/li>\n<li>Proof of the grandparent&#8217;s Italian citizenship and a negative certificate of Israeli citizenship, as well as any other document the consulate deems useful to establish the citizenship status of the ascendant&#8217;s grandparent, such as, for example, an extract from the Italian birth certificate with annotations.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>CASE 4 \u2013 The minor is the child of an Italian national who lived in Italy for at least two consecutive years after acquiring Italian citizenship and before the child&#8217;s birth.<\/p>\n<ul>\n<li><a href=\"https:\/\/ambtelaviv.esteri.it\/wp-content\/uploads\/2025\/07\/2025-Trascrizione-atto-di-nascita_fin.pdf\">Application<\/a> form duly completed and signed by both parents;<\/li>\n<li>Original Israeli birth certificate (photocopies are not accepted) complete with &#8220;Apostille&#8221; (for more information on obtaining an Apostille, click <a href=\"https:\/\/www.mfa.gov.il\/mfa\/consularservices\/pages\/publicdocumentseng.aspx\">here<\/a>);<\/li>\n<li>Italian translation of the birth certificate;<\/li>\n<li>Photocopy of both parents&#8217; passports or identity cards;<\/li>\n<li>Proof of legal presence in Israel (visa\/Teudat Zeut);<\/li>\n<li>Historical residence certificate issued by the municipality of residence in Italy, certifying two years of continuous residence prior to the birth of the child (hard copy with original sicgnature, digitally signed certificate or certificate issued from ANPR).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"text-decoration: underline;\">ATTENTION \u2013 In any case, the consulate reserves the right to request additional documentation to verify compliance with the legal requirements, upon which a specific consular declaration will be issued.<\/span><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>STEP 2 \u2013 Submitting the Documents<\/strong><\/p>\n<p>Once the documentation is complete, mail it to the Italian Embassy in Tel Aviv \u2013 Consular Office, 25 Hamered Street, Tel Aviv 68125.\u00a0Alternatively, you can bring it to the Consulate and leave it in the mailbox at the entrance of the Embassy on the 21st floor of the Trade Tower Building at 25 Hamered Street, Tel Aviv, during opening hours.<\/p>\n<p>Please note: the date of receipt and filing of the application at the Consulate is the date of receipt at the Consulate. Therefore, any email exchanges are not to be considered equivalent to the submission of the original translated and apostilled documents.<\/p>\n<p>Translations of documents must be correct and complete. Once the documentation is received, any errors will need to be corrected before it can be sent.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Please note, the original certificates will not be returned but will be kept in our consular archive.<\/strong><\/span><\/p>\n<p>If you do not fall into one of the above-mentioned categories, it may be possible to <a href=\"https:\/\/ambtelaviv.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/acquisition-of-citizenship-by-benefit-of-law-minor-children-born-abroad\/\">register your minor child&#8217;s birth through a specific declaration, which will allow him\/her to acquire citizenship pursuant to Article 4, paragraph 1-bis.<\/a><\/p>\n<p>____________________________________________________________<\/p>\n<p><span style=\"text-decoration: underline;\"><strong><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">ATTENTION: Surrogacy <\/span><\/span><\/strong><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Surrogacy is a completely legal practice in some countries, but is <span style=\"text-decoration: underline;\"><strong>prohibited<\/strong><\/span> in Italy by <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.presidente.della.repubblica:2004;40~art12!vig=#:~:text=Chiunque%2C%20in%20qualsiasi%20forma%2C%20realizza,a%20un%20milione%20di%20euro.\">Law 40 of February 19, 2004<\/a>. <\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">This law was recently amended to provide, in Article 12, paragraph 6, that the penalties for <span style=\"text-decoration: underline;\">its violations apply even if done abroad<\/span>.<\/span><\/span><\/p>\n<p><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">This Consulate, upon receipt of a birth certificate of a child born abroad via surrogacy and to be registered at an Italian municipality, shall process the registration request by sending the certificate to the municipality and, at the same time, shall report the alleged crime to the competent local Public Prosecutor&#8217;s Office.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"ATTENTION: NEW CITIZENSHIP REGULATIONS Legislative Decree No. 36 of March 28, 2025, converted into law with amendments, has introduced new restrictions on the acquisition of Italian citizenship pursuant to Article 1 of Law 91\/1992.
