Following the recent changes to the art. 23 of Legislative Decree 30/2007, ALL non-EU family members of Italian/EU citizens who intend to live permanently in Italy – including Israeli citizens/passport holders – MUST apply for a D type (National) visa for family reasons.
The family members who have the right to reunification are exclusively those indicated in the art. 2 of Legislative Decree 30/20007:
- the spouse;
- the partner who has contracted a registered partnership with the EU citizen on the basis of the legislation of a Member State, if the legislation of the Member State host equates such registered partnership to marriage and in compliance with the established conditions by the relevant legislation of the host Member State;
- direct descendants under the age of 21 or dependents and those of the spouse or partner as per letter b);
- direct ascendants and those of the spouse or partner referred to in letter b, if financially dependent.
Adoptees/adopters are also considered as equivalent to the direct descendant/direct ascendant, as well as minors subjected to permanent guardianship/custody pursuant to Law. 184/83.
The applicant who intends to apply for a visa for family reasons must provide:
- Invitation letter from the Italian/EU family member by which he/she states the intention to exercise the right to family unity, accompanied by a valid identity document;
- Civil status documentation certifying the status of family member pursuant to art. 2 of DL 30/2007, translated and legalized (with an Apostille, when applicable), or confirmation of the registration of marriage or civil union as transcribed in Italy;
- In cases where financial dependency assessment is envisaged: demonstration of economic remittances by the Italian/EU citizen. The financial support must be structural and continuative in its nature (there is no minimum duration) and must allow the beneficiary, in consideration of his/her financial and social conditions in the State of origin or provenance, to provide for his/her essential needs (COM(2009)313 paragraph 2.1.4)
The visa is issued free of charge, and the requests for an appointment to lodge the visa application the request will be treated expeditiously
