PLEASE NOTE: Surrogacy
Surrogacy is a completely legal practice in some countries but it is prohibited in Italy under Law 40 of February 19, 2004.
This law was recently amended, specifically in Article 12, paragraph 6, stipulating that the penalties for violations of this law also apply to actions by Italian citizens, even if done abroad.
In cases where this Embassy is requested to register a birth certificate for a child born via surrogacy, the Embassy shall proceed with the transcription request while simultaneously notifying the competent “Procura della Repubblica” (Italian Prosecutor’s Office) of the potential criminal offense.
Individuals are therefore strongly urged to consider the potential legal and personal consequences that may arise from violating Italian law.
